MESOTHELIOMA AND LUNG CANCER- Asbestos Philadelphia area

Asbestos-Mesothelioma and Lung Cancer
Your Exposure
Your Health
Your Rights

YOU MAY HAVE BEEN EXPOSED ASBESTOS AND DON'T KNOW THIS.

Asbestos is a mineral which was used for its heat resistant and strength qualities. It was used by many trades in numerous products and even household products.

Asbestos causes Mesothelioma and Lung Cancer. Mesothelioma is a very rare form of cancer whose only know cause in the United States is asbestos exposure.

It takes from 10 to 60 years or longer after the first exposure to asbestos for a person to develop Mesothelioma. Short term, intense exposure may cause Mesothelioma many years later. Research by the EPA has concluded that any asbestos exposure may be sufficient to cause disease.

WHO IS AT RISK?

People who worked directly with or around asbestos such as insulators, shipyard, refinery, maintenance, building trades, and utility workers, military personnel, auto mechanics and others are at risk for developing Mesothelioma and Lung Cancer. This is known as occupational exposure.

Other people at risk are the spouses and children of those who worked with asbestos and brought asbestos home on their clothing. People, such as school teachers and office workers, who worked in buildings which contained asbestos are also at risk. These are known as household, non-occupational or indirect exposures and are similar to second-hand smoke.

People who performed or were present during residential and commercial building construction, renovations and remodeling are also at risk for developing Mesothelioma and Lung Cancer.

People who lived or worked near an asbestos mining or manufacturing facility are also at risk.

It is important to determine how, when and where you were exposed to asbestos.

WHAT ARE YOUR MEDICAL OPTIONS?

MESOTHELIOMA: is a cancer of the lining of the chest, the lining of the abdominal cavity or the lining of the heart.

Presently, there is no known cure for Mesothelioma. However, there are treatments that may improve the quality and quantity of life for people with Mesothelioma.

TREATMENTS FOR MESOTHELIOMA include:

Chemotherapy
Radiation Therapy
Surgery
Palliative Therapy
Experimental Therapies

Lung Cancer: is a cancer of the lung and air passages. Cigarette smoking and asbestos exposure combined to increase a person's risk of developing Lung Cancer by 50-90 times. Treatment options are similar to those for Mesothelioma.

SYMPTOMS

IF YOU OR SOMEONE CLOSE TO YOU IS PRESENTLY EXPERIENCING OR HAS EXPERIENCED:

SHORTNESS OF BREATH
PAIN IN THE SHOULDERS, SIDE, BACK, CHEST OR ABDOMEN
PERSISTENT COUGH OR HOARSENESS
UNINTENTIONAL WEIGHT LOSS
UNUSUAL FATIGUE
DIFFICULTY SWALLOWING
DRENCHING NIGHT SWEATS
UNEXPLAINED FEVERS
NAUSEA, VOMITING OR LOSS OF APPETITE
REDUCED ACTIVITY TOLERANCE

CONTACT A PHYSICIAN IMMEDIATELY.

A CHEST X-RAY, CT SCAN, MRI OR PET SCAN CAN OFTEN DETERMINE THE PRESENCE OF MESOTHELIOMA AND LUNG CANCER

LEGAL OPTIONS

If you have been diagnosed with Mesothelioma or Lung Cancer, you may have legal rights to sue the manufacturers, distributors, and suppliers of the asbestos products for your injuries. Also, you may have legal rights to sue the contractors who installed and or/removed asbestos products as well as your employer. In many situations, the family of a deceased person may bring a lawsuit for personal injuries and/or wrongful death. Be aware that each state has a time period, known as statute of limitations, within which a person or the estate of the deceased person must file a lawsuit to be entitled to monetary compensation or be forever barred from any recovery. Each state has it’s own law regarding the time period to file a lawsuit and those laws are strictly enforced.

Please call LT Pepper Law for a free consulation. 267.626.7546

Medical malpractice

An estimated one million people are injured by errors during hospital treatment each year and 120,000 people die as a result of those injuries, according to a study authored by an expert from the Harvard School of Public Health. More people die from medical negligence each year than from the combined total fatalities due to motor vehicle accidents, falls, drowning and aviation incidents. These mistakes are rarely reported to the general public. Frequently, when confronted with a medical malpractice claim, the health care industry resorts to attacks on both lawyers and patients who are alleged to have filed groundless and frivolous medical malpractice lawsuits.

When someone has been injured by the medical negligence of a physician or hospital, expert legal assistance is required to place the victim on the same playing field with the health care industry and their tremendous resources in the ensuing litigation. Luke Pepper has a reputation for vigorously representing the interests of victims who have been injured by the negligence of health care professionals such as hospitals and physicians. My firm and network consists of attorneys with extensive knowledge in the complex medical and legal issues frequently faced in medical malpractice litigation. I have successfully represented people injured by medical malpractice in many different areas of medical practice.

Through many years of practice in this extremely complex area of litigation, Luke Pepper has developed the resources and the skill necessary in order to obtain the most favorable outcomes on behalf of their clients.

Estate planning- Philadelphia Area

Peace of mind is one of the main goals when thinking of estate planning. Having an estate plan means that you have the framework in place to make sure your wishes are carried out.

Sometimes, estate planning involves drafting a simple Will to set up a framework to divide your assists. From a financial standpoint, it can include the drafting of instruments to reduce inheritance and estate tax liability, establishment of Trust agreements to protect minor children.

When patients are incapacitated, the medical provider will ask a family member to decide on continued medical treatment or to end life-sustaining treatment when there is simple hope for recovery. To prepare for this possibility, many people decide to have a "Living will" or healthcare declaration in place. A living will or healthcare declaration appoints a person to decide with consultation of the medical provider whether to continue treatment in the case of incapacitation.

If you require estate planning, please contact LT Pepper Law for a free consultation. 267 626 7546

Birth injury

Birth injuries present serious emotional, financial, and physical burdens to the victims and families. A common cause of birth injury is the interruption of oxygen to the brain which can cause brain damage and cerebral palsy. Other issues with the pregnancy or birthing process can cause significant problems to the child.

When a physician or other medical professional acts appropriately, birth injuries can be avoided. The failure to recognize a potential issue or improper treatment of a birth injury can lead to a permanent injury. In many instances, the heath of the child and the prevention of a birth injury are connected to the heath of the mother. Health issues of the mother have to be monitored to prevent injury to the mother and the child during the birthing process. Other birth injury cases stem from labor itself. If the physician fails to detect improper positioning of the child in the birth canal, or fails to correctly respond to a situation of this nature, serious birth injury can result.

Birth injury can lead to years of rehabiltation and permanent injury. An experienced attorney will review all the issues presented by this dramatic injury. If your family has been through this trauma, please contact LT Pepper Law for a free consultation.

With people living longer and longer, more and more people are spending the final years of their lives in nursing or elder care facilities making the standard of care provided by these facilities extremely important. (4) infections

(5) inappropriate use of physical restraints.

Mortgage Refinance or New Homeowner assistance

Over the past few years, homeowners were presented with many choices in mortgages. Homeowners were told that the typical or standard 30 year or 15 year fixed rate options were unavailable or a "better" or "cheaper" alternative was available. Lenders came up with many different mortgage options including interest only or adjustable rate mortgages. In many instances these options were made available so the lenders could charge additional fees to the homeowner. The consequences to the homeowner was a secondary or not a concern at all.

While the days of these mortgages may be in the past, many homeowners are fighting to keep their homes because they cannot make payments on these "sophisticated" mortgages after the terms changed. Many consumers do not understand that there may be assistance through government programs or through traditional lenders.

Consumers deserves to have their rights protected. As a free service to consumers and as part of our on going commitment to consumers, LT Pepper Law can connect you with a lending consultant who may be able to assist you. While this is not a legal service, we believe consumers should have access to information and services to make an informed decision.

If you are a new homeowner without the issues discussed above, we can also provide you with information to assist in your home purchase.

Please feel free to call 267.626.7546 with any questions.

Permax

On March 29, 2007, the FDA announced that manufacturers of pergolide drug products, which are used to treat Parkinson’s disease, will voluntarily remove these drugs from the market because of the risk of serious damage to patients’ heart valves. The products being withdrawn are Permax, the trade name for pergolide marketed by Valeant Pharmaceuticals, and two generic versions of pergolide manufactured by Par and Teva. Pergolide is in a class of medications called dopamine agonists and is used with levodopa and carbidopa to manage the symptoms (tremors and slowness of movement) of Parkinson’s disease.

Recent studies show that Permax and associated drugs increase the risk of valvular regurgitation. Valvular regurgitation is a condition where the valves malfunction and blood flows backwards causing the heart to enlarge and work harder. If left untreated, a patient can develop congestive heart failure and die. If the disease progresses enough, a patient can undergo surgery to replace or repair their heart valves.

If you or your loved ones took Permax or related drugs and had heart complications and or heart surgery, please call LT Pepper Law at 267.626.7546 for a free consultation.

Pain Pumps

Many people have shoulder injuries which require surgery. In some instances, physicians prescribed and implant what is called a "Pain Pump". The pain pump is designed to manage the pain associated with shoulder surgery. When implanted properly, a pain pump can manage a patient's pain effectively.

When the pain pump is installed improperly, serious problems can develop. When a pain pump is implanted where the medication is released in the shoulder joint, it is toxic to the cartilage. This can cause a condition known as Postarthroscopic Glenohumeral Chrondrolysis. This conditions causes pain and stiffness in the shoulder joint and limits the range of motion. Some patients require surgery to replace the shoulder joint damaged by the pain pump.

If you, friend or family member have had a pain pump and damage to your shoulder, please call Luke Pepper at 267.626.7546 for a free consultation.

Raptiva

On April 8, 2009, Genentech announced the withdrawal of Raptiva. Raptiva is used to treat psoriasis, a skin disorder. Raptiva is being withdrawn because patients develop the risk of contracting Progressive multifocal leukoencephalopathy, a rare and serious brain disorder. Progressive multifocal leukoencephalopathy is a rare and usually fatal viral disease that is characterized by progressive damage or inflammation to the white matter of the brain. The disease is rare and usually linked to patients with compromised immune systems due to transplants or other viral diseases.

LT Pepper Law is investigating potential cases related to Raptiva exposure. If you or a loved one has been treated with Raptiva, please consult your physican immediately. If you believe that you or a loved one were injured, please contact Luke Pepper at 267.626.7546 for a free consultation.

Defective Chinese Drywall

In 2005, the import of Chinese Dry wall increased dramatically due to a result of drywall shortage driven by the housing boom and hurricane Katrina. Tests of Chinese drywall has shown certain gases are emitted which corrode electrical and plumbing components made of copper. Thousands of homes may have used the contaminated drywall.

LT Pepper Law is investigating claims related to Chinese Drywall. If you believe you have a claim and have suffered heath problems or property damage, please call Luke Pepper at 267.626.7546 for a consultation.

Levaquin

Tens of thousands of people are damaged by Levaquin antibiotics each year, yet nearly all those damaged remain undiagnosed or misdiagnosed. Exposure to Levaquin can cause death, gastrointestinal reactions, allegeric reactions, liver disease among conditions

Determining whether or not you have a case can be very complicated. If you believe you or a loved one was injured after taking Levaquin, please call Luke Pepper at 267.626.7546 for a free consultation.
Gadolinium is a contrast agent used in certain diagnostic tests such as MRI or MRA to get a clear picture of a patient's organs and tissues. Gadolinium is also referred to as radioactive dye. Gadolinium is removed by the kidneys. When the kidneys are diseased and/or impaired, the body cannot remove the Gadolinium and it remains in the body with toxic effect. In some instances, a patient will develop a condition called nephrogenic systemic fibrosis or nephrogenic fibrosing dermopathy. Symptoms of nephrogenic systemic fibrosis or nephrogenic fibrosing dermopathy include itching, swelling or hardening of the skin. As the condition progresses, the patient develops joint or muscle pain and difficulty straightening their legs.

To investigate a suit, an attorney must identify when you were exposed to the Gadolinium and idenify the manufactuer. If you or a loved one has experienced these symptoms following a MRI or MRA, please call Luke Pepper at 267.626.7546 for a free consultation on whether you have a potential claim against the manufactuer of the Gadolinium.
